Bush Threatens to Veto ENDA

President confirmed once again that he is a homophobe. He issued a Statement of Administrative Policy in which he threatens to veto the Employment Non-Discrimination Act. He has also threatened to veto the federal hate crimes bill.

Ah, the stench of compassionate conservatism.

H.R. 3685 would extend existing employment-discrimination provisions of Federal law, including those in Title VII of the Civil Rights Act of 1964, to establish “a comprehensive Federal prohibition of employment discrimination on the basis of sexual orientation.” The bill raises concerns on constitutional and policy grounds, and if H.R. 3685 were presented to the President, his senior advisors would recommend that he veto the bill.

H.R. 3685 is inconsistent with the right to the free exercise of religion as codified by Congress in the Religious Freedom Restoration Act (RFRA). The Act prohibits the Federal Government from substantially burdening the free exercise of religion except for compelling reasons, and then only in the least restrictive manner possible. H.R. 3685 does not meet this standard. For instance, schools that are owned by or directed toward a particular religion are exempted by the bill; but those that emphasize religious principles broadly will find their religious liberties burdened by H.R. 3685. A second concern is H.R. 3685’s authorization of Federal civil damage actions against State entities, which may violate States’ immunity under the Eleventh Amendment to the U.S. Constitution.

The bill turns on imprecise and subjective terms that would make interpretation, compliance, and enforcement extremely difficult. For instance, the bill establishes liability for acting on “perceived” sexual orientation, or “association” with individuals of a particular sexual orientation. If passed, H.R. 3685 is virtually certain to encourage burdensome litigation beyond the cases that the bill is intended to reach.

Provisions of this bill purport to give Federal statutory significance to same-sex marriage rights under State law. These provisions conflict with the Defense of Marriage Act, which defines marriage as the legal union between one man and one woman. The Administration strongly opposes any attempt to weaken this law, which is vital to defending the sanctity of marriage.

    The wingers at Concerned Women for America (doesn’t that name make you want to puke?) issued the following statement:

    “This dangerous bill would pit the government directly against the free exercise of religion, which is unconstitutional on its face. Members of Congress should join the President and exercise their sworn duty to defend the U.S. Constitution by voting ‘no’ on ENDA.”

    Gee, we told by members of the Congress and self-annointed gay rights leaders that all would be well in the world if transgendered people were thrown under the ENDA bus.

    Looks like Speaker Botox and Barney Frank got played again by Bush. When will these lame-ass MFs learn you can’t negotiate with Bush?

    Have you noticed any swelling or bruises on your legs? Any fang marks on your ankles? I ask because it’s the mean season for snakes in the grass.

    It seems that our ‘guardians’ in the Democratic and Republican are acting like a herd of angry rattlers. Gay basher and liberal (but very rich) Democratic house leader Pelosi and the treacherous Barney Frank are ramming their toothless version of ENDA through Congress, giving the bosses who want to underpay us just what they want. It’s payback against the majority of activists and activist organizations because we had the utter cheek to criticize them for their sellout.

    Worse, it’s an across the board attack on unions, GLBT communities and the rights of all working people because it totally eliminates civil rights for transgendered people, sacrificing part or our community on the altar of dirty deals done dirt cheap. If you can believe anything said by the Bigot in Chief in the White House it’s his promise to veto even the toothless Democrat version of ENDA. The sordid gutting of ENDA was altogether unnecessary.

    And it gets worse still. Shills for Hillary claim that Frank and Pelosi gutted ENDA to mollify their Republican cousins, but Republicans aren’t their real worry. Today the DC insider journal THE HILL says that freshman Democrats are going to the House leadership to kill the original ENDA and retain the gutted Democrat version. Reps. Ron Klein (Snake In The Grass Party – Fla.) and Tim Walz (Snake In The Grass Party – Minn.), leaders of the freshman class of Democrats, carried a message to Speaker of the House of Greed Nancy Pelosi (Snake In The Grass Party – Calif.) on Tuesday “that their fellow first-term lawmakers did not want to vote on an amendment extending civil rights to transgender employees… ”

    The spineless or outright bigoted Congressional Democrats are terrified that if they vote for us their bribes, oh sorry, campaign contributions, from business owners will dry up. Then they can’t stay in the House of Greed and they’ll never get a chance to become liberal (but very rich.)

    In other news Barak Obama is slithering around mimicking Hillary Clinton’s appeals to christian bigots. They’re like liberal (but very rich) John Edwards, a cotton mouth viper who invested his twenty three million dollar plus fortune in a mortgage company that shamelessly forecloses on Katrina victims. (Edwards finally quit after the NY Times exposed him.) Clinton, Obama and Edwards are not our friends; they’re our enemies just as much as their Republican cousins.

    Meanwhile a pacific sidewinder named Dianne Feinstein, a liberal (but very rich) Democrat helped Bush to seat homobigot-misogynist-and racist Leslie Southwick on the U.S. Court of Appeals for the 5th Circuit in New Orleans. She used tawdry backroom deals to corral a dozen or so Democrat senators into a backstabbing posse.

    Southwick will be there ‘til he strokes out, punishing GLBT folk, unions, women and minorities. Pray that he likes hog maws ‘n gravy.

    Obama will have to sneak much further and faster to the right to pilfer Clinton’s bigot supporters. She’s been on the trail courting christians for over a year and it shows in her poll numbers and her draw from bigoted Republicans and christians.

    Liberal (but very rich) Hillary Clinton got her early lead because she and liberal (but Very rich) Bill Clinton supported the federal DADT and DOMA laws that shoved GLBT folk into second class citizenship. DOMA was enacted with a bone crushing bipartisan majority of 85-24 in the Senate and 342-67 in the House. After the Democrats and Republicans voted for DOMA Bill Clinton rushed it into law to attract antigay voters in the congressional elections that occurred two weeks later in the fall of ’96. Snake in the grass Party radio spots featuring Clinton trumpeting the purity of heterosex marriage and the perils of samesex marriage began playing in Southern states immediately after he signed it. (This appeal to ‘purity’ was before those odd stains showed up on Lewinsky’s dress.)

    The whole thing boomeranged and the Democrats lost anyway. So did we when DOMA spread to 36 states. 509 bipartisan bigoted politicians changed our lives for the worse. Keep that in mind when you hear some apologist claiming that Democrats are “better” than Republicans.
